Auction terms

These agreements are legally binding. They describe the buyer's rights and "Offentlig Auktion.dk" obligations in connection with the services that "Offentlig Auktion.dk" offers via this website.
It is a condition for registration as a bidder/buyer that you have read and understood the agreement. It is free to register with "Offentlig Auktion.dk". When you register, you agree to the terms of this agreement.
1. "Offentlig Auktion.dk" is an internet-based auction platform with the possibility of physical inspection of the auction objects by appointment.
therefore, both trade between companies of objects for commercial use or resale and for private use are offered. This means that both companies with a valid CVR number and private individuals can be approved and registered as buyers. The data provided by all applicants is validated in available registers.
2. All foreign business buyers' registered CVR numbers must originate from countries that are not fully or partially covered by the embargo conditions that are registered on the Danish Ministry of Foreign Affairs' website in this regard at any time, or otherwise acceded to by Denmark.
3. You must be over 18 years of age to register and use "Offentlig Auktion.dk". Otherwise, orders will be canceled immediately.
4. Buyer's premium is differentiating and depends on the object and bid amount and varies from 5-20%. Buyer's premium is updated as of 2026.
Therefore, the total bid amount, including buyer's premium and costs and including VAT, is displayed in the information field under the bids listed when you are logged in as an approved bidder.
This ensures full transparency for bidders before bidding.
Emails regarding registration of bids, as well as outbids from other bidders can be selected and de-selected under "My page" - Settings
5. "Offentlig Auktion.dk" cannot be held responsible for the condition, legality and environmental properties of an object. The described condition is not complete in any way and objects can be inspected by appointment.
6. Everything is sold in the condition in which it is and as classified without further responsibility for "Offentlig Auktion.dk".
Since prior to an auction there has been an opportunity for inspection, the won auction/purchase is not covered by the general right of complaint and any complaints will be rejected.
In the case of private purchases, a 14-day right of withdrawal applies, calculated from the time of winning the auction/purchase in accordance with the law.
From the auction closing, the purchased objects remain at the buyer's risk. Ownership is only obtained when the invoice has been registered and paid.
7. In the event of the seller's inability to deliver, for whatever reason, the buyer waives the right to claim or sue for compensation, or any loss, including the buyer's right to a replacement purchase, direct or indirect loss, loss of expected income opportunities or any form of compensation. In the event of non-delivery, the auction winner is only entitled to a refund of the advance payment in relation to his auction bid without interest and without additional costs.
8. "Offentlig Auktion.dk" will close any auction if there is suspicion of attempted fraud or other forms of fraud.
9. The auction system is designed so that each new bid is assigned a consecutive "bid ID" number. A new winning bid extends the auction for an additional 5 minutes after the scheduled end. The auction ends when the highest bid has been unchanged for 5 minutes.
10.a. The auction system is designed with an "autobid" function. Autobid follows the same set of rules for bid increases as regular bids and counterbids until the upper limit is met. In this case, an email is received stating that the bidder's autobid has now been outbid by another bidder.
Own bids are marked with a different color tone on the bid line and with * and own Autobids are marked with (A*). Other people's Autobids are marked with (A)
If the autobid - at or above the reserve price, is not passed, then the autobidder has won the auction. All bidders can use the autobid function. See example in FAQ section 23 If you are a bidder at the auction and an autobid is placed on the same, you will outbid your already leading bid with the current bid increase for the auction.
NOTE: Please be aware of possible delays due to network speed and the speed of your PC.
"Offentlig Auktion.dk" is not responsible for operational disruptions and errors that occur as a direct or indirect result of communication errors, input errors, crashes/operational disruptions on the Internet, the auction system's servers, hardware or software. We encourage you to place bids in good time and not in the last seconds, as this may result in the auction ending before bids are received and registered.
11. Minimum bid increase is set in relation to the value of the current bid value: as shown here:

• 1 - 5,000 DKK. min. bid increases by 100 DKK. Incl. Possible VAT
• 5,001 - 25,000 DKK. min. bid increases by 200 DKK. Incl. Possible VAT
• 25,001 - 50,000 DKK. min. bid increases by 500 DKK. Incl. Possible VAT
• 50,001 - 125,000 DKK. min. bid increases by 1,000 DKK. Incl. Possible VAT
• 125,001 - and up million. min. bid increases by 2,000 DKK. Incl. Possible VAT
12. Buyer's premium: current bid as well as current buyer's premium and costs incl. VAT appear in the box under bid after bid entry.
13. The total invoice will be:
The winning bid + Buyer's premium + Invoice fee DKK. 125, Incl. Possible VAT = total invoice in DKK.
14. Any bid - even below the reserve price, is legally binding until 16:00 (CET) the following business day after an auction has closed. If an auction has not reached the reserve price, the seller is exempt. However, the seller can choose either to accept the highest bid received, or through "Offentlig Auktion.dk", to submit a counter-bid to the bidder.
15. When the closing bid is above the reserve price, the winner will receive an email confirming the purchase with an invoice attached. The purchase is only valid when the invoice has been received. If the seller accepts the highest bid (below the reserve price) before 16:00 (CET) the following business day, the bidder will receive an email confirming the purchase, and the bidder will then receive an email with an invoice.
16. All purchases of auction objects and/or additional services are invoiced directly via email in the hours after the auction ends, invoice fee of DKK 100.00 incl. Possible VAT. This invoice is paid directly to the “Offentlig Auktion.dk” bank, which handles cash flows for all parties. The deadline for payment is 5 calendar days from the invoice date. If payment is not received in the “Offentlig Auktion.dk” system within the specified payment deadline, this will be considered a breach of the agreement according to the “Offentlig Auktion.dk” terms. The result is that the transaction will be canceled without notice. However, the buyer is still obliged to pay the buyer's fee to cover the costs, the amount is at least 2,000. DKK and a maximum of 10,000 DKK. Incl. VAT.
When paying, the buyer is responsible for any fees to his own bank and no bank fees are accepted from Danish buyers.
17. When payment has been received by the bank, the buyer will be informed with contact information for “Offentlig Auktion.dk” via e-mail from info@offentligauktion.dk. The buyer must contact “Offentlig Auktion.dk” for delivery and arrange collection within 14 days of the end of the auction.
NOTE: In the case of commercial sales, payment may only be made from the company's bank account.
18. All objects are sold from the specified location.
19. The buyer must collect all purchased objects within 14 days after the hammer blow, unless otherwise stated at the auction or agreed. If an object is not collected, “Offentlig Auktion.dk” has the right to sell the object again. In the event of resale, the buyer will only be compensated for the part of the purchase price paid that exceeds 30,000 DKK incl. possible VAT. “Offentlig Auktion.dk” is entitled to deduct any reasonable additional costs that the seller has incurred due to the failure to collect.
20. “Offentlig Auktion.dk” cannot be held responsible for lack of access to the auction site for any reason.
21. “Offentlig Auktion.dk” reserves the right to change the terms. If this happens, the bidders will be informed and in connection with login, the bidder must approve the changed terms.
21 a. “Offentlig Auktion.dk” reserves the right to deny a potential buyer the right to create an account without further reason.
22. As a bidder, I agree that my personal data may be used to receive marketing material regarding products and / or campaigns from “Offentlig Auktion.dk”, through the information I have provided. It can be cancelled at any time by email to info@offentligauktion.dk
As a bidder, I also agree that my IP address is logged for the sake of safe and secure trading for both seller and bidder.
23. “Offentlig Auktion.dk” may transfer data that we have received from you to our approved service providers who have a direct part in the implementation of the overall transaction. “Offentlig Auktion.dk” does not disclose information to third parties who are not a direct part in the implementation of the overall transaction.
24, “Offentlig Auktion.dk” is registered in Denmark at Bødkervej, 4450 Jyderup. CVR number 46214021
E-mail: info@offentligauktion.dk. Any dispute is subject to Danish law and will be decided by the Copenhagen City Court in accordance with applicable law.

25. VAT regulations are in accordance with Danish VAT law. Items, commissions and services purchased are subject to VAT. “Offentlig Auktion.dk” helps our customers, but cannot be held responsible for VAT claims that may arise if the buyer's documentation used is untrue, fraudulent or incomplete. Domestic buyers must always pay VAT.
26. The buyer is responsible for compliance with all applicable laws/regulations in connection with the transport of the purchased item after collection, including any export out of Denmark including applicable VAT conditions
27. VAT
Since this is a collection sale, the buyer is the exporter himself and the following therefore applies:
Buyers from other EU countries: The buyer is obliged to document that the item has been transported out of DK and to the EU country in question. This documentation means that the purchased item can be exported without VAT surcharge.
Buyers from countries outside the EU:
VAT:
Since VAT, customs duties and documentation requirements often differ depending on the country and type of object outside the EU, the buyer must use an authorized freight forwarder who can ensure correct documentation for both the seller and the buyer.
Dual-use:
If it is a registered "dual-use" product, this can only be delivered to the buyer when an export permit has been obtained from the relevant authority.
It is the buyer who must ensure export documentation and any export permit for dual-use products, applicable to both the buyer and the seller.
